Terms and Conditions for Onboard Analytics Theft Tracking App

These Terms and Conditions ("Terms") govern your use of the Onboard Analytics Theft  mobile application (the "App"), which is owned and operated by Onboard Analytics Limited ("we", "us", or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Purpose of the App

Onboard Analytics Theft Tracking is designed to allow users to input the vehicle registration number of a vehicle that has been reported stolen to any relevant UK police force and receive tracking assistance in the event the vehicle is reported stolen. The App is intended solely for lawful use where a legitimate use case can be demonstrated under GDPR.

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use this App. You must have been instructed to use the app by a registered Onboard Analytics Limited customer. By using the App, you represent and warrant that you meet these eligibility requirements.

3. User Obligations

By using the App, you agree that you:

• Will only register and track vehicles that you are legally authorized to track;

• Will not use the App for any unlawful, harmful, fraudulent, or malicious purposes;

• Will provide accurate and truthful information when registering a vehicle;

4. Use of Location Services

The App may utilize GPS or other location-based services to help identify the potential location of a reported stolen vehicle. You consent to the collection, use, and sharing of location data as described in our Privacy Policy.

Note: Tracking accuracy is not guaranteed and may be affected by various factors including but not limited to device compatibility, signal interference, or network issues.

5. Privacy Policy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal data. By using the App, you agree to the collection and use of your information in accordance with the Privacy Policy.

6. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, software, images, and graphics, are the property of Onboard Analytics Limited and are protected by intellectual property laws. You may not copy, reproduce, modify, or distribute any part of the App without our prior written consent.

7. Disclaimers

The App is provided on an "as is" and "as available" basis. We make no warranties or representations, express or implied, about the accuracy, reliability, or completeness of the App's services.

We do not guarantee:

• That the App will be uninterrupted, secure, or error-free;

• That any stolen vehicle will be located or recovered;

• That the information provided will be accurate, complete, or up-to-date.

Use of the App is at your own risk.

8. Limitation of Liability

To the fullest extent permitted by law, Onboard Analytics Limited, its affiliates, and its service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or vehicle recovery failure, arising out of or related to your use or inability to use the App.

 

8A. No Liability for Data Accuracy or Misuse

You acknowledge and agree that:

• The information provided by the App, including but not limited to location data, vehicle information, or other data, is sourced from third-party providers and/or user inputs and may not always be accurate, complete, or up to date.

• Onboard Analytics Limited does not verify the accuracy of any third-party or user-generated data and does not guarantee the reliability or availability of such information.

• You are solely responsible for how you use any data obtained through the App. Any reliance you place on such data is at your own risk.

We accept no legal responsibility or liability for:

• Any inaccuracies, errors, or omissions in the data displayed within the App;

• Any actions taken or decisions made by you or any third party based on such data;

• Any misuse or unauthorized use of the data by you or others.

Misuse of the App or its data for unlawful purposes may result in account termination and could be reported to relevant authorities.

 

9. Termination

We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, if we believe you have violated these Terms or engaged in unlawful or harmful activity.

10. Modifications

We may update or modify these Terms from time to time. Any changes will be effective immediately upon posting the revised version on the App. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in England.
